Sued by collection agency for medical bills help !!!!!?

My husband and I went the other day and found a folded note in our door. It was a summons to appear in small claims court for 400 medical expenses + 400 for attorney fees. We pay bills and make or have trouble paying what the insurance does not work. We pay 900 per month for family benefits. This is huge for us, we have never been to court. My question is. Can we call the prosecutor and the development a payment plan before the hearing date? Can we ask him to take a settlement? Are we responsible for paying the legal fees for the agency recovery which has hired? I am so amazed. We pay 400 bills. Thank you all. This has been a tough week.
